LUPC sends replat request on to commissioners

At the October Hot Springs County Land Use Planning Commission (LUPC) board meeting, County Planner Bo Bowman presented the proposal for a replat of Tract 14 of the Wyoming Lasting Legacy Subdivision by applicants Troy and Breez Daniels; and Lynn & Shantel Sheehan.

The applicants want to divide Tract 14, an Owl Creek Common area of 5.60 acres, into three nonresidential lots. The intent is to divide this acreage between the present-day landowners, rather than have them owned in common.

The Wyoming Lasting Legacy Subdivision was recorded in 2008. It established 12 RV and cabin lots (ranging in area from 0.21 ac. to 0.29 ac.) arrayed around an internal loop drive. The original intent was to plat Tracts 1 through 12 as private RV or cabin lots, and operate the subdivision as an RV campground. This plan did not materialize, and the corporate entity was allowed to expire recently.

Since 2008, only two residences have been constructed on the premises, on Tracts 1 and 7. The other ten RV/cabin tracts in the subdivision are owned by the owners of the two residences on Tracts 1 and 7. A third structure is a clubhouse on Tract 15, originally intended for the RV campground.

Planner Bo Bowman also said in his staff recommendation that a notation shall be placed on the final plat for the division of Tract 14, stating that no residential structures shall be erected on these three lots. However, non-residential structures, such as livestock buildings or fences, would be allowed.

LUPC Chairman Adam Estenson opened the meeting for public comments. There were none. Also, there were no checklists required for this application because it was simply a replat and there was no land use change request.

The LUPC voted and passed the approval to recommend the application to the Hot Springs County Commissioners.
