Probation in conspiracy case

Monday afternoon in Hot Springs District Court, Judge Bobbi Overfield sentenced Byron Huffstetler to three years of supervised probation on a charge of conspiracy to deliver a controlled substance.

The charge stems from a Dec. 23, 2018 controlled buy incident, during which Huffstetler was found to have less then one gram of methamphetamine. Prior to sentencing, he acknowledged his guilt in the matter and said he made the mistake of getting involved in drugs. Having put himself in treatment, he learned what drugs can do to a person and is ready to be clean.

Defense attorney Michelle Burned also noted Huffstetler engaged in treatment early, and would be finishing that treatment this week.

Judge Overfield said Huffstetler’s actions thus far show he is capable of complying with the terms of probation. She also pointed out this is the only charge in his criminal history, and recommended he finish his after care program.

Under Wyoming Statute 17-301, if he successfully completes his probation Huffstetler will not have this felony charge on his record. Judge Overfield warned him that the court does not look favorably on those who are given such opportunities and fail to successfully complete probation.

Also in district court Monday, a plea agreement was presented in a case against Jack Hillan, who is charged with possession of meth and possession of marijuana.

The charges are from a March 17, 2018 incident. Subsequent to a warrant arrest, Hillan’s vehicle was searched and found to contain items containing meth and marijuana.

Under the proposed plea agreement, Hillan would plead to possession of marijuana and the possession of meth would be dismissed. He would receive a sentence of three to five years, though that would be suspended for four years of supervised probation. He will be sentenced at a later date.
